When you make a Donation to Warrenton Chorale:

  • You acknowledge that all Donations are voluntary and may be tax-deductible to the extent allowed by law. Warrenton Chorale is a 501(c)(3) registered nonprofit organization. Please consult with a tax professional regarding the tax deductibility of your Donation.
  • You acknowledge that Donations may be non-refundable unless specifically stated otherwise or required by law.
  • If you make a recurring Donation, you authorize Warrenton Chorale to charge your payment method on a recurring basis until you cancel. These charges are handled via our third-party vendor, Vanco Payment Solutions ("Vanco"). We do not directly store or process your credit card or financial account numbers on our services.

We will use commercially reasonable efforts to ensure that all Donations are used in accordance with our stated mission and purposes. We reserve the right to decline or return any Donation at our discretion.

8. Volunteer Services

If you provide volunteer services to Warrenton Chorale:

  • You acknowledge that you are not an employee of Warrenton Chorale and are not entitled to compensation or employee benefits.
  • You agree to comply with all applicable policies, guidelines, and instructions provided by Warrenton Chorale.
  • You grant Warrenton Chorale permission to use photographs, videos, or other recordings of you while volunteering for promotional or educational purposes.
  • You acknowledge that Warrenton Chorale may conduct background checks or require additional information before accepting your volunteer services.

9. User Content

You may have the opportunity to submit User Content to our services. You retain ownership of any User Content you submit, but you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such User Content in any media or distribution methods. This license authorizes us to make your User Content available to the rest of the world and to let others do the same.

You represent and warrant that you have all necessary rights to grant us this license and that your User Content does not violate any third-party rights or applicable laws.

We reserve the right to remove any User Content at our discretion.

Warrenton Chorale DOES NOT WARRANT THAT OUR SERVICES ARE ACCURATE, COMPLETE, RELIABLE, CURRENT, OR ERROR-FREE. Warrenton Chorale DISCLAIMS ALL LIABILITY FOR ANY ERRORS, OMISSIONS, OR INACCURACIES IN THE CONTENT PROVIDED THROUGH OUR SERVICES.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Warrenton Chorale BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

17. Indemnification

You agree to indemnify, defend, and hold harmless Warrenton Chorale, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from your violation of these Terms, your User Content, or your use of our services. Warrenton Chorale reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with Warrenton Chorale in asserting any available defenses.

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

19. Dispute Resolution

Any disputes arising from these Terms will be resolved through binding arbitration in accordance with the American Arbitration Association rules. The arbitration shall take place in Warrenton, Virginia. You agree to waive any right to a jury trial.

20. Entire Agreement

These Terms, including our Privacy Policy, constitute the entire agreement between you and Warrenton Chorale regarding your use of our services and supersede any prior agreements between you and Warrenton Chorale relating to your use of our services.

21. Waiver and Severability

The failure of Warrenton Chorale to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

22. Assignment

These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you without the prior written consent of Warrenton Chorale, but may be assigned by Warrenton Chorale without restriction.

23. Termination

We reserve the right to suspend or terminate your access to our services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of our services, us, or third parties, or for any other reason. Upon termination, your license to use our services will immediately cease.
